Terms of use of the online shop faniem.lv

 

Definitions of terms

Online Shop – Internet site with website address www.faniem.lv. Customers can buy goods provided by the Seller at the Online Shop according to the present terms.

Customer – any individual buying goods at the Online Shop www.faniem.lv.

Seller – SIA „Olimpiskais sporta centrs”/www.faniem.lv

Shopping cart – range of items selected by the Customer at the Online Shop.

Item – material unit that can be bought at the Online Shop www.faniem.lv.

Order – Customer’s order at the Online Shop www.faniem.lv for the purchase and delivery of selected items to the address indicated by the Customer.

Courier – JSC “Latvijas Pasts”, Reg. No. 40003052790, registered address: 10 Ziemeļu Street, Lidosta “Rīga” (Airport Riga), Mārupe Mun., LV-1053 delivering the items to the Customer by express post on behalf of the Seller.

Terms – the terms of use of the Online Shop www.faniem.lv.


General provisions

  1. The present Terms establish the relations between the Customer and the Seller

  2. In addition to these Terms any legal relations arising of the sales of goods at the Online Shop are stipulated by the laws and regulations of the Republic of Latvia.

  3. The owner and administrator of the Online Shop is SIA “Olimpiskais sporta centrs”.

  4. The present Terms, as well as information placed at www.faniem.lv about the goods is public.

  5. The assortment and prices of goods are subject to change without a prior notice. Images and description of items placed at the Online Shop shall not always be completely representative. Therefore prior to buying any goods and, if necessary, the specification of Items may be clarified sending e-mail to info@faniem.lv or calling + 371 67387700.

  6. For the purpose of improving the Online Shop and increase its safety level, the Seller is entitled to amending / replacing / improving the present Terms. Any amendments to the Terms are published at the Online Shop www.faniem.lv. Such amendments shall enter into force after being published. Orders made prior to publishing amendments are subject to Terms in force as at the date when the Order was made, unless stipulated otherwise by the Terms and laws and regulations.

  7. By ordering goods via the Online Shop www.faniem.lvthe Customer accepts the present Terms.

 

Registration

  1. Goods may be bought by registered and non-registered Customers. The Customer shall bear full responsibility for the accuracy and credibility of the information provided at the registration at www.faniem.lv.

  2. If the Customer chooses to register himself/herself, he/she shall fill in an application form providing all relevant information. The information provided is stored at a data base. A username and password is sent to the Customer to email he/she has indicated in the application form; afterwards the username and password shall be used for online shopping at www.faniem.lv. The Customer shall be liable for the confidentiality of the username and password and shall not disclose these to any third parties. If the Customer suspects a disclosure or use of his/her username and password by any third parties, he/she shall immediately inform the Seller of this by sending an email to the email address indicated in the Seller’s contact information. Such email shall be sent from the email address the Customer has indicated on the application form.

  3. Where the Customer chooses not to register himself/herself, i.e. be a guest, he/she shall fill in all mandatory fields and place the order.

  4. Registered users may subscribe to discount notifications. Should a Customer not wish to receive these anymore, he/she can refuse the service at any time by sending relevant request to email address of the Seller info@faniem.lv.


Privacy policy of the Customer’s data and safety measures for transfer of card data

  1. All and any personal details of the Customer visiting the Online Shop and making payments for the goods, are deemed confidential and shall not be disclosed to third parties. Data processing ensures the safety of personal and banking details of the Customer.

  2. The Seller is only entitled to process the Customer’s personal details as much as necessary for meeting the Terms, maintenance and operation of the processing system, as well as in line with the statutory provisions.

  3. Personal details are stored safely and are processed fairly and legally. All and any technical and organisational measures are implemented on a regular basis to protect the Customer’s personal information against unauthorised and illegal processing, including encrypting it according to applicable industry standards.

  4. Accepting payment cards, authorisation of transactions is performed online; the Seller uses the services of MasterCard Secure Code/Verified by Visa and American Express. Processing of the Customer’s payment cards and authorisation services are provided by FirstData. The Seller does not hold and process the Customer’s payment card data; these data are sent to FirstData for processing.

  5. Accepting payments via PayPal, authorisation services are provided by PayPal. The Seller does not hold and process the Customer’s payment data; these data are sent to PayPal for processing.

  6. The Customer’s data is protected against deleting, transformation and unauthorised use. Data base containing personal data of the Customers is protected against unauthorised access by third parties via computer network.

  7. The Seller is entitled to transferring personal data of the Customers to the Courier, where this is necessary to fulfil the orders made at the Online Shop www.faniem.lv and meeting the present Terms. Transfer of personal data of the Customers to third parties for commercial purposes is forbidden.

  8. The Seller is only entitled to process of the Customer’s personal data as much as necessary to meet the present Terms, maintain and operate the processing system, and in line with the statutory provisions.

  9. The Customer’s personal dataare stored as long as necessary to process the order made by the Customer, to process return of payment, reply to a complaint or provide advertising information to the Customer to which the Customer has subscribed to.


Goods

  1. Goods and their key features can be found under relevant subsections of the Online Shop www.faniem.lv.

  2. In certain cases the number of items to be bought may be restricted.


Price of Goods

  1. The price of goods is given in euro (EUR).

  2. The price includes the value added tax.

  3. The price is subject to change and may be set only for a limited period of time. The Seller is entitled to change or cancel the prices of goods.

  4. The price does not include delivery costs. If an order is placed equalling to or exceeding EUR 700, the delivery is included in the price and no additional delivery costs shall be paid.


Discounts

Goods may be subject to discounts and special offers. Discounts and special offers are applied for a limited period of time


Placing orders

  1. The Customer chooses goods. The fastest way to choose the desired items is to type the title of item in the “search” field of the Online Shop. The goods may also be found in the Catalogue of goods that is available at the Online Shop.

  2. When the the order has been completed – size, colour, model, number – the exact price is calculated. When an item is selected, it is added to the Shopping cart by clicking “Add to Shopping cart”.

  3. To make sure the size of selected item is correct, please check the table of sizes before adding item to the Shopping cart. If there are any uncertainties about the correct size, please contact the Seller calling + 371 67387700.

  4. The number of goods in the Shopping cart may be changed by clicking “Refresh order”. To continue placing your order, click “Approve”, that will take you to the order template.

  5. The Customer has to select at the order template the appropriate type: place an order as a registered user, as a new user, or a guest.

  6. When placing an order the Customer shall fill in all mandatory fields and indicate the delivery address and payment form.

  7. If the Customer chooses a courier delivery, name, surname, delivery address and phone of a person receiving the goods has to be indicated.

  8. When the order is complete, the Customer has to click on the section “Pay”, where the relevant payment form can be chosen and the order is completed.

  9. After the order has been placed, the Seller sends an automatic approval of the order to the Customer to the given email address. Please note that the approval of the order does not mean it has been accepted. All orders are subject to an acceptance procedure. The order is deemed accepted and completed, when the goods are sent to the Customer, and the Customer has been informed of this to the given email.


Payment

  1. There are the following payment forms available:

    1. Via transfer based on invoice;

    2. Via payment card Maestro, MasterCard, VISA,VISA Electron and American Express;

    3. Via PayPal.

  1. After choosing the payment form, the Customer has to click on „Pay”.

  2. If the Customer chooses to pay by bank card, the bank card data has to be filled in. Depending on the card, the Customer may be requested to enter additional data to guarantee the security of transaction. Request for further information is sent by the authority issuing the payment card.

  3. Payment card owners are verified and authorized both by FirstData and by the authority issuing the payment card, therefore security can ensured, as well as fraud may be prevented.

  4. The order is cancelled, if a payment is not made within 5 (five) working days.

  5. Before placing the order and making the payment, the Customer shall accept the present Terms. This is done by ticking a special box.


Processing and delivering of the order 

  1. The Customer’s order is processed not later than within 2 (two) working days after the Customer has approved the order and has paid for the goods.

  2. The payment is deemed made in the following ways:

    1. By transfer – when the payment for the goods is debited at the Seller’s account;

    2. By payment card – when the Seller has received an approval on successful transaction from FirstData;

    3. By PayPal – when the Seller has received an approval on successful transaction from PayPal.

  1. In the Republic of Latvia the goods are delivered within 4-10 working days, outside Latvia – within 14 (fourteen) working days after the payment has been made. In exceptional cases (due to overload of the Courier or due to working specifics) the delivery period can be prolonged. In such cases the Seller shall immediately notify the Customer thereof, and shall inform of the prolonged delivery term.

  2. Delivery expenses are covered by the Customer. The expenses are calculated, when the Customer has finally placed the order.

  3. The delivery can be carried out in the following ways:

    1. By Courier to the delivery address given by the Customer in any place in the territory of the Republic of Latvia or beyond its borders;

    2. Onsite at the shop at Olympic Sports Centre at 6B Grostonas Street, Riga, LV-1013 (working hours Monday-Friday 10a.m.-8p.m., Saturdays 10a.m. – 6p.m.).

  1. At the moment of delivery the Customer is handed over an application template for returns. The template includes the following information – title of the seller, address and description of return rights. More information on return rights see in section “Return rights”, where the title of the seller, address and description of return rights is provided.

  2. At the moment of delivery the goods are handed over to the following persons:

    1. If the addressee is a natural person – only to the individual indicated in the bill of delivery or any other person subject to presenting a personal ID and who can indicate his/ her name, surname, date, time and sign on the document approving the delivery;

    2. If the addressee is a legal entity – to the contact person indicated in the bill of delivery or any other representative of the addressee (secretary, office manager, administrator etc.), who can indicate his/ her name, surname, date, time and sign on the document approving the delivery (if company’s stamp is available, seal it as well).

  3. If the goods are delivered to the Customer by Courier, the delivery expenditures depend on the delivery location, country of delivery, amount and weight of items, and are subject to the price list of the Courier.

  4. If the delivery address is outside the territory of the Republic of Latvia, at the moment of delivery additional fees and duties, according to the law of the country of delivery, may be applied. Such fees and duties shall be paid by the Customer.

  5. If the Customer, who has indicated the delivery address in the territory of the Republic of Latvia, rejects the delivery or refuses to sign the supporting documents, the Courier does not hand the delivery over to the addressee and returns it to the Seller. If the delivery could not be handed over, it is stored in the relevant post office for 10 (ten) days, including the first day when the delivery was not completed. If during 10 (ten) days the addressee has not been present at the address and cannot be reached by phone, the delivery is returned to the Seller with a notification of the reasons for the failure of delivery. In these cases the Seller has to repay the Customer the amount paid for the goods, deducting the expenses for return of the delivery according to the price list of the Courier.

  6. If the Customer, who has indicated the delivery address outside the territory of the Republic of Latvia, rejects the delivery or refuses to sign the supporting documents, the Courier does not hand the delivery over to the addressee and returns it to the Seller. If the delivery could not be handed over, it is stored at the relevant post office for 30 (thirty) days, including the first day the delivery failed. If during the 10 (ten) days the addressee has not been present at the address and cannot be reached by phone, the delivery is returned to the Seller with a notification of the reasons for the failure of delivery. In these cases the Seller has to repay the Customer the amount paid for the goods, deducting the expenses for return of the delivery according to the price list of the Courier.


Cancellation of order, exchange and return of goods

  1. The order may be cancelled 1 (one) day after it has been placed. To cancel the order the Customer has to contact the Seller via email info@faniem.lv and informing thereof. The notification shall include: Customer’s details, Order number and Customer’s bank account, to which the payment made by the Customer for the goods shall be returned. As soon as the order is cancelled, an email will be sent to the Customer’s email address to approve the cancellation. The Customer can cancel all Order or certain items ordered.

  2. After cancellation of the Order the amount paid by the Customer for the goods is returned to the Customer within 10 (ten) days.

  3. The cancellation is not possible if the item is confirmed, the order is processed and delivered to the Customer. If at the moment of delivery of the goods the Customer establishes that any item of the delivery is wrong or incompliant, the Customer may ask:

    • to exchange the item;
    • to replace the incompliant item at the Seller’s cost or compensate costs incurred to the Customer for eliminating the incompliance;

    • to repay the amount paid by the Customer for returning the goods to the Seller.


  4. If the goods are returned, the Customer has to ensure:

    • the packaging of the goods is not damaged;
    • the goods have not been used, as a result of which their value has decreased;

    • the goods have not been used, as a result of which its quality has decreased (it may not have been washed, ironed or undergone any other actions, which may have had an adverse impact on its condition).


  5. The goods are returned to the Seller to the following address: Olympic Sports Centre, 6B Grostonas Street, Riga LV1013.

Return rights

  1. Any Customer, which is deemed a consumer according to the provisions of the Consumer Rights Protection Law, may exercise the return rights.

  2. The Customer is entitled to execute the return rights and unilateral termination of the contract within 14 (fourteen) calendar days, starting from the day of the receipt of goods. The execution of the return rights shall be done in line with the Consumer Rights Protection Law.

  3. During the term of execution of the return rights the Customer is entitled to use the goods only to the extent it is necessary for inspecting the goods (to the extent it might have been done if purchased at an onsite shop). By executing the return rights the Customer is liable for the use of the goods beyond the term for checking the goods, i.e. decrease in the value, quality and safety of the goods.

  4. The Customer is obliged to inform the Seller on return of goods by email to info@faniem.lv and to return the goods to the Seller within 14 (fourteen) days by attaching a filled in returns form.

  5. Should the Customer execute return rights, the Seller, not later than within 30 (thirty) calendar days after receipt of a written refusal, or within 7 (seven) calendar days after receipt of documents confirming a successful payment, refund the Customer the amount has paid for the returned goods via transfer to the bank account given in the details of the Customer.

  6. If the Customer executes the return rights and it is not due to the incompliance of any items with the contractual provisions (i.e., the goods are conform with the placed order), the Customer is obliged to cover all costs related to to sending the goods back.

  7. If the Customer returns goods that do not comply with the contractual provisions(i.e., goods do not conform with the placed order – wrong colour, size, model etc.), costs related to sending the goods back are born by the Seller.


Warranty

  1. All goods purchased from the Online Shop www.faniem.lv are subject to 2 (two) years warranty.

  2. During the warranty period the Seller may:

    1. Repay the Customer the sum paid for the goods;

    2. Exchange the goods for the proper ones;

    3. Eliminate deficiencies at own cost;

    4. Take any other measures, if the item is not in line with the warranty or description in the advertisement.


  3. During the warranty period the Customer has to keep the original packaging, the cashier’s check, mandatory receipt of payment or bank statement.
  4. The warranty is not applied if the Customer:

    1. has damaged the goods due to inappropriate use/ wearing;

    2. has damaged the goods intentionally;

    3. has violated the recommendations of the manufacturer regarding use/ cleaning/ wearing of the goods.


  5. The Seller is not held liable for non-fulfilment of the service or delayed settlement of any liabilities in respect to the Customer due to force majeure circumstances.


Miscellaneous

  1. All and any disputes in relation to the present Terms, where such disputes between the Seller and the Customer cannot be settled via negotiations, shall be decided by court according to laws and regulations of the Republic of Latvia.

  2. Copying of any information from the Online Shop www.faniem.lv is subject to prior approval by SIA “Olimpiskais sporta centrs”.
